TALLAHASSEE – An appeals court docket has refused to dismiss a lawsuit in opposition to Miami-Dade County stemming from a 2016 incident through which a drunken driver crashed via a fence at a baseball field and severely injured a person.
Javier Perez, who was principal of South Dade High School on the time, was attending his son’s baseball recreation at Tamiami Park when he was struck by the car. He suffered accidents that in the end required amputating his legs, in accordance with Wednesday’s ruling by a three-judge panel of the third District Court of Appeal.
Perez filed a lawsuit alleging negligence by Miami-Dade County, which argued it ought to be shielded from the case by sovereign immunity. A circuit decide refused to dismiss the case, and the appeals court docket upheld that call.
